Question 2
Just got my license, so do I need auto insurance?... I just got my license, and my parents are about to put me under their policy, but it won't happen until Monday, so can I still drive using their car that is insured?
Answers
1) No one can stop you from driving. However, keep in mind that (God forbid) if you get into an accident, you're going to get in a lot of trouble (mainly financially).
I would just play it safe and be patient until Monday. - - DP -
2) When I go looking for replacement car insurance is a no brainer way to save on car expenses. You can get a easy estimate online they always give you competing quotes.
I know people who have used and recommend http://www.InsureAutoNow.info - Lisette C
3) I would worry about not having your name on a policy! Trust me, you'd rather wait a few more days than to wait another year because of a license suspension to drive! Just be patient, it is worth the wait.
The penalties for driving without insurance can be very severe. You could get some rather large fines, lose your license, be forced to pay for an SR22, and permanently have people distrust you financially.
I know you want to get into that car and drive (congratulations on passing the test!), but patience is your best option at this time. - The Unrequited Fantasy
4) You can drive right now, as long as the car is insured. But if you get in an accident and you're not on the policy you're looking at a huge bill probably 3x what it is now. - Daniel
5) you waited 16 years a few more days will not hurt you. trust me you don't want to get in any kinda wreck with no insurance. and sad to say you are a beginner driver you will make more mistakes than other drivers will, not trying to be a pessimist but that's just the way it is but congrats on the licenses - Csr1
6) Not legally. Don't do it. You could lose your license for another 4 years. - clncarplz

Question 3
If a car hits my car due to a hit from a third party, who is responsible to pay for the damages on my car?...
Answers
1) It depends upon the state you live in. Some states are 'no fault', meaning your insurance company pays for the repairs no matter who caused the accident. In most states, however, the person who caused the initial accident will be responsible for the damage to your car. - This Guys Sez
2) everybody but you - ken k
3) It will all depend on the state the accident occurred in. Some states are classified as "No Fault" states which means that your insurance company will fix your damages and the other drivers insurance company will repair their drivers damages. If your state is not a no fault state it will depend on the accident and what caused the accident. Most likely the driver who actually caused the accident will be responsible for your damages as well as the driver of the car who hit you. If the police were called to the accident scene they will get statements and complete their report and issue any tickets to the guilty parties. If there are no un-ordinary circumstances regarding the accident, I would suspect the driver who initially caused the accident will liable for all damages to everyone vehicles. - fortyniner
4) Whoever hits you is totally responsible for your damage. It doesn't matter if a flying saucer hit them and pushed them into you, they are responsible. They may have a claim against someone else, but that won't affect you in any way. - oklatom
5) The third party who originally caused the accident. - the kid

Question 5
Can police accident report be challenged/changed?... Can police accident report be challenged/changed?
I live in NY. I was coming out of a parking lot in my car and was behind another car. The lady who was driving the other car saw a parking spot on her right. She turn left a little bit and started to back up to park her car in that vacant parking spot in reverse. She didnt see my car and kept on coming. I tried to warn her by honking but she didnt listen and finally hit my front left bumper. We both came out of our cars and she start apologizing and said i am really sorry, i didnt see you.....things like that. When i said that mam i have to call the cops because the damages are not minor on my bumper and she again said that she has driving issues and if we could settle this some other way. I told her i cant and call the cops.
Cops came...they listened to me to her and said to get the police report for the local precinct. I didnt know what she told them but it looked to me like she accepted her mistake.
Ok...now the police accident report came and it said "MV1 (hers) had a collision with MV2 (mine) causing minor damage to both bumpers". I called her insurance company and they accepted the liability and sent me a check of my damages. They even explained me that the report is not so clear but the codes show that she did unsafe backup.
Today i got a call from my insurance company and they told me that her insurance company called them and said that she is not accepting her fault (she said i hit her from back) and was very unhappy that her insurance company accepted the liability and wants them to do investigation.
I know i have taken a lot of ur time but i am really worried now whats gonna happen. Can she challenge the police report or can the insurance company go against the police report?
Thanks
Answers
1) Sure. But, you need facts or witnesses or something to back-up your claims. If her insurance company is trying to change things after-the-fact, it sounds like it's up to them to cough-up the facts or the witnesses, not you. - rick29148
2) She can, but it won't work. - the kid
3) Anybody can challenge a police report. The front page part that identifies the time, location, and parties involved in an accident is usually admissible in court. The narrative part on the back side with the story about what happened is frequently tossed unless the police officer can testify that he/she actually saw the accident happen. Otherwise it's just hearsay.
Have you already cashed the check? If so it's a bit late for them to be coming back to you about it. They accepted your claim, they reviewed your damages, they made you an offer, and you accepted it.
If you've been paid and your insurer hasn't paid anything then they're probably going to tell the other insurer to get lost. Buried in almost every insurance policy (except for medical and legal malpractice policies) is a clause that says something like "we will settle claims made against you as we see fit". As such the other driver has no recourse against her own company.
The other insurer can still file a claim against you and your insurer will either defend you or pay the claim. It's bizarre but occasionally situations happen where both carriers separately agree their own person was at fault and both people get their claims paid by the other party. It doesn't happen often but it does happen. - Rogue Claims Adjuster
4) The report can be challenged in court but highly unlikely as it is a minor accident & they have already paid you. By the way Do Not accept any %age of the blame. To an ins. co. 50% means all. - clncarplz
