Whose responsibility is it to pay the deductible when someone hits your car and you are not at fault?...  I had been rear ended by someone recently. Do I pay the deductible or the other person inorder to have my car fixed? Can someone explain...thank you.

2)   If the other person is at fault, they pay all costs to have your car fixed. Their insurance company handles all liability. Make sure you have their insurance information so you can contact the insurance company directly about reimbursement. 7)   You dont pay anything...Im not sure what country you live in but in Australia if someone hits you, they are at fault. All you have to do is ring your insurance company, they will fix your car and chase their insurance company for the money. If they dont have insurance you can try to organise a payment plan with them, or you can simply take them to court. If you dont have insurance, you should ring their insurance company, however they cant fix your ar untill they pay the excess or as you call it, deductible, and if they dont pay the excess you have the right to take them to court and their insurance policy most probably wont defend them becasue it was part of their policy to pay the excess and they didnt. However, if you were hit in the rear and it was caused by you, you can still do all these things but if the other driver disputes that it was not his fault, he can take you to court and try and prove you wrong. When is the car consider a loss by car insurance?...  I got rear ended about 10 days ago. Progressive is there insurance, they total her car. The first estimate they did on my car was like $2,000 I have a 2004 Bmw 530i..I took it to a reputable bmw repair shop and they did the tear down and now the adjuster is telling me its gonna be around 12,000 to repair, I owe 18,000 and blue book value is probably even less.



I don't want to be driving around a car with that much extensive repair that's ridiculous. My car will never be the same! What should I do? Any ideas? I have a attorney but he says he dosn't deal with the property damage part..which I think is stupid too since I'm not supposed to talk to this claim adjusters..but how do I get this handle?
I want my car to be total..I dont want to be driving a car that is worth $15,000 before the accident with $12,000 in repairs..it dosnt make sense! Would you feel safe to drive a car with $12,000 in car repairs?

Document everything and submit a demand that details everything. You will probably not get $12,000, but you will get a lot more money. The problem in your case is that there is a complete difference in opinion -- one is $2,000 and one is $12,000. You need to prove that your vehicle is going to cost a lot more in order to repair. 5)   An insurance company will consider a car a total loss when the amount of the damages exceeds (or will probably exceed) the value of the car minus what the salvage (the wrecked hulk) is worth after the accident. This usually works out to about 80% of the pre-accident value of the car though depending on circumstances it may be a little more or less.



Tell the insurance company where you want the car fixed. They cannot tell you where to take it though in some states the fair claims practices act requires an insurer to provide you with the name of a shop that will do the repairs for what they wrote.



Remember in most states the other person's insurance company is not obligated to deal with you in good faith. If you don't like what Progressive is doing just call your own company and file your claim with them. If you have collision on the car your own company is obligated to pay your claim no matter who's fault the accident is. You'll have a deductible to pay if the car is fixed but presumably your company will get it beck for you from Progressive when they settle everything.



If the car is totaled the insurance company is only obligated to pay you the (pre-accident) market value of the car. It doesn't matter what the loan amount is. That's between you and the bank.



If the car is totaled and you owe more than the car is worth the bank may waive the difference, they may roll the balance due into your next car loan, or they may send you a bill.



Check on your own insurance and your finance papers if you have "GAP" coverage. This coverage will cover the difference between what the car is worth and what you owe. A lot of people actually do have gap coverage and don't know they do until something like this happens. this is because a lot of dealers slip it into your finance agreement to inflate the cost.



Some insurers in some states will also pay you for "loss of use" (rental car) even if you don't rent a car. They are obligated to do this in some states but not others. Some companies pay it even if they don't have to. - Rogue Claims Adjuster

1)   Well not sure about Arizona but doubt theres that much of a difference in permit tests.



When I took it, less then a year ago it was pretty easy, just make sure you know your stuff.



It is multiple choice, and it's based on simple stuff like what signs mean what, what to do in certain situations, etc.

1)   There are many factors, mainly on the type of insurance you need. Do you need full coverage (and how much)? Or can you get away with just liability (if you own the car outright).

They need the info to get your parents an accurate rate. There are a lot of factors like number of drivers, number of cars, make/model cars, miles driven, drivers history, area you live, multiple policy discounts. Not every company is going to give you the same rate. No company is best everywhere.

I got a ticket in my friends car..will it affect her insurance?...  okay so yesterday i got a ticket in my friends car..and the cop said i might have to go traffic school or i might just get lucky and just have to mail something back when my ticket comes into the mail hopefully that's wat happens but anyway im just wondering does my getting a ticket in her car mean her insurance goes up? or anything happen to her sinces its her car??

i havent even told her i got the ticket yet lol i was hoping that i could just hide it but my friend said her insurance will go up because of me :(

1)   Unless you are a named driver on your friend's insurance policy, it won't affect her premiums. Traffic tickets follow the driver, not the car. The insurance company will probably never even know that she let you use her car. - lj1
